Case shows danger of contractal indemnification clauses
A nonprofit organization providing training for public school students is contractually obligated to indemnify and defend the school district against the district’s own negligence when two students were allegedly molested sexually by a trainer, according to the Supreme Court of Louisiana. (Berry v. Orleans Parish School Board, No. 2001-CC-3283, 6/21/02.)
