Foundation Must Pay for Using Designer's Plans
Court says Foundation would be unjustly enriched when it hired designer and failed to pay his firm for work done
A nonprofit foundation may not avoid the costs of designing the entrance to its science theater by hiring the designer after preliminary work has been done and not paying the design firm for the work.
A Court of Appeals in Tennessee has reversed a trial court decision and held that the foundation would be unjustly enriched by the work and should be required to pay the design firm. (Mill Creek Associates v. The Jackson Foundation, Ct. of App., at Nashville, No. M2001-02811-COAR3-CV, 3/11/03.)
