Foundation employee used matching gift program
to get $70,000 from charities receiving contributions
The Third Circuit Court of Appeals has affirmed a two-year sentence for a private foundation employee who was convicted of obtaining at least $70,000 in kickbacks from charities for which he had arranged matching gifts from the Foundation.
The Court affirmed the trial court’s reasoning that the “loss” on which the sentence should be calculated was the full $324,875 in matching contributions made by the Foundation, not solely the $70,000 that the analyst obtained.
