when policy was not issued until after event
When a participant in a charity ski race was injured during the race, he sued the nonprofit sponsor and one of the volunteers who helped staff the race. The sponsor, a nonprofit providing outdoor programs for individuals with disabilities or special needs, tendered the claim to its insurer. The insurer, who did not issue its policy until after the event, disclaimed liability.
A federal District Court in Utah has held that the policy covers claims by the participant against the organization and the volunteer.
