Court denies summary judgment to dismiss
case against woman who signed d/b/a School
When the Adler School of Professional Psychology in Chicago agreed that Adler School of Professional Psychology, Ontario (a Canadian corporation) could operate as a satellite school for Adler Chicago, they agreed that Adler Ontario would collect and remit to Adler Chicago a fee for each student credit hour. In 1995, Linda Page, then affiliated with Adler Ontario, signed an agreement setting forth the payment terms with a signature line, “Linda Page, d/b/a Adler School of Professional Psychology, Ontario.”
When Adler Chicago sued for $180,000 in back payments, Page moved, without conducting discovery, to dismiss the case against her as an individual. A federal District Court in Illinois has refused.
