For-profit health club’s effort to enjoin operation
of fitness center dismissed after 10 years of litigation
The Pennsylvania Commonwealth Court, in its third consideration of an effort by a for-profit health club to enjoin the operation of a YMCA fitness center, has affirmed the dismissal of the club’s claim. The Court has held that the Y’s operation of its fitness center is related to the its charitable purpose and cannot be enjoined under the state’s unique small business protections in the Institutions of Purely Public Charity Act.
