Denial of permit is substantial burden
in one case, but only “modest” in another
The Seventh Circuit Court of Appeals has construed the Religious Land Use and Institutionalized Persons Act (RLUIPA) in two cases in which local governments have sought to deny religious organizations the right to use their property for religious purposes. In one case in Chicago the Court has found that the City’s effort to prevent a Christian sect from continuing a use similar to that of the YMCA from which it bought the property is a “substantial burden” on the organization and not justified. In the other case in Peoria, the Court said refusal to permit a church to demolish an historic building was only a modest burden that should be sustained.
